Scope of ADR


ADR mechanisms have been extensive used in civil matters. But in a short it is now being in the administration of criminal justice system also which is further extended to the sphere of Juvenile justice system. In our country in The Code of Criminal Procedure, 1898 have inserted some provision as Section 345 and sehedule-2 of the Code of regards to the compromising offence of the Penal Code. The application of ADR and area are spearing day by day over the globe[1]. Generally ADR applied in civil, commercial, industrial, familial, contract, insurance, partnership business, real estate etc. But it is considered as a best way of solving regards to the international commercial disputes. ADR successfully access and peacefully try to solve the dower, maintenance, divorce, restitution of conjugal life, guardianship, succession and on the familial matter which are getting mental depression of common people of the society. It is extended to differences in values and beliefs between communities, personal interests love and domination over one another power struggle contest between candidates or parties to win election, mistrust suspicion of one another, injustice exploitation by economic and other means, denial of right to resources, religious practice, political campaign etc[2].
